GUARDIANSHIP
The role of a Legal Guardian is to care for your children should something happen to you both.
It is incredibly important to make this decision with care; the guardian of your children will become responsible for their entire welfare (Education, Finances, physical and emotional needs).
If you do not appoint a legal guardian for your children, the courts may make this decision: particularly if there are conflicts within your family.
Consider all aspects to determine your decision on who should be taking care of your children upon your death, including their financial and physical capabilities.
Tips:
* Give some specifics about how you know this person, why you have selected them, why and how you want this person to raise your children.
* Discuss your choice with the person you have selected and make sure they are willing to accept the responsibility should it become necessary.
* Draft a letter with the signed acceptance from the chosen guardian.
Here is a sample letter for this purpose.
* You can name a person to be the Guardian of the children's money and finances, or you can name a separate person. Remember to make this clear and provide details.
* Think outside the box; consider separating the functions. (Finances, Education etc.)
* Plan to revisit the issue. Remember to update your Will.
**Considerations:
* Who already has a good relationship with your child(ren)
* Where do they live?
* Do they share your values?
* How about their age and health?
* Are they financially and emotionally sufficient to take care of your child(ren).. and will you be able to provide financial assistance?
